第八屆Brigham-Kanner財產權利會議將于10月14日-15日在清華大學法學院舉行

美國聯邦最高法院前大法官奧康納將親赴北京領獎

一、會議概況

財產權利會議(Brigham-Kanner Property Rights Conference)是為紀念Toby Prince Brigham和 Gideon Kanner而命名的。該會議至今已經舉辦了七屆,取得了極大的國際影響力,對于推動財產法的發展起到了至關重要的作用。2011年,第八屆財產權利會議(8th Annual Brigham-Kanner Property Rights Conference)將由清華大學法學院和美國威廉瑪麗學院法學院聯合主辦,于10月14日至15日,在清華大學法學院模擬法庭召開,這也是該會議第一次在美國以外舉行。

財產權利會議主要由法官、律師和學術界人士共同參與,探討財產權保護的最新發展狀況。在每屆會議期間,主辦方都將為在該領域做出突出貢獻的人士頒發年度Brigham-Kanner財產權利獎。目前獲得Brigham-Kanner獎的人士包括哈佛大學法學院的Frank I. Michelman教授 (2004 年)、 芝加哥大學法學院的Richard A. Epstein教授(2005年)、范德比爾特法學院的James W. Ely教授(2006 年)、密歇根大學法學院Margaret Jane Radin教授(2007 年)、耶魯大學法學院的Robert C. Ellickson 教授(2008 年)、哈佛大學的Richard E. Pipe教授 (2009 年) 和亞利桑那大學法學院的Carol M. Rose教授(2010 年)。 此次會議歷屆獲獎者均將與會,相信會是一次學術界的盛會。誠摯歡迎包括憲法、民法、環境法學者在內的廣大中國學者、法官和律師參與。

二、2011年Brigham-Kanner Property Rights 獎的獲獎者

此次第八屆Brigham-Kanner Property Rights獲獎者為美國聯邦最高法院前大法官桑德拉·戴·奧康納(Justice Sandra Day O’Connor)。桑德拉·戴·奧康納于1981至2006年期間擔任美國聯邦最高法院大法官。奧康納在斯坦福大學獲得法學士學位,1981年9月,由時任總統里根提名,成為美國歷史上第一位擔任聯邦最高法院大法官的女性,她因此而被載入史冊。在最高法院,從她的投票來看,已很難看出她的政治偏向,她的投票常被看作獨立選票。從最高法院退休后,奧康納成為威廉瑪麗學院的校長。她在凱洛訴新倫敦市案(Kelo v. City of New London (2005))中廣泛引用不同的意見,已經被強烈認可為財產法律體系的關鍵性觀點。2010年5月,威廉瑪麗學院法學院為表示對她杰出成就與領導能力的認可,授予她最高榮譽Marshall-Wythe Medallion(馬歇爾-威斯獎章) 。

此次會議作為第8屆Brigham-Kanner Property Rights Winner,81歲的奧康納大法官將親赴北京,在清華大學接受頒獎并發表演講。

The panel will also compare the role of lawyers in the field of private property rights under different legal systems.
