8:30 - 9:30 | Session 4: 藥品鏈接制度以及其他藥品專利問題 Patent Linkage and Other Pharm Patent Issues This session will include the latest legal updates of patent linkage system, key pharm patent invalidation cases, roles and functions of FDA, the patent office and courts, requirements and preparations of 4.2 statement filed to FDA, the doctrine of equivalents in pharm patent infringement and its impact on patent linkage system. |
9:30 - 10:30 | Session 5: 海外活動對國內訴訟的影響 Impact of Overseas Activities on Domestic Patent Litigations This session will include (1) the effect of validity and scope arguments in patent litigation Country A on parallel issues in litigation in Country B; (2) strategic sequencing in transnational patent litigation (where to file first, how to use an outcome in Country A to create strategic pressure in litigation in Countries B and C; and (3) sequencing and stacking of design protection actions in different jurisdictions to create a transnational “web” of overlapping and supporting design protection. |
